This thesis aims to illustrate how Iris Marion Young's democratic model is based on Habermas' deliberative democracy, highlighting more carefully the inclusion in the legislative process of social groups who have less political influence due to the discriminations they have faced and still currently do. Moreover, it aims to trace some similarities between the concept of representation described by Young and the one elaborated by Hegel in the "Elements of Philosophy of Rights". Ultimately, the thesis will address some problematics of the structure of this model: it does not fully consider the fact that the direct participation of the citizens - either in form of assembly, groups or corporation- cannot be fully considered as a part of the constitutional process, since the social organization emerges only on an empirical level and not politically after the legitimization of an illimited power.
In questa tesi si vuole illustrare come il modello democratico elaborato da Iris Marion Young si basi sulla democrazia deliberativa Habermasiana, sottolineando con maggiore attenzione l'inclusione nel processo legislativo di gruppi sociali che hanno meno influenza in quanto soggetti a discriminazioni. Inoltre, si vuole tracciare delle similitudini tra il concetto di rappresentanza descritto da Young, con quello presentato da Hegel. In conclusione, la tesi sottolineerà le problematiche della struttura presentata, in quanto non considera pienamente il fatto che la partecipazione diretta dei cittadini -sotto forma di assemblee, gruppi o cerchie- non può essere pienamente considerata come del processo costituzionale, dato che l’organizzazione sociale emerge solo a livello empirico e non politico, dopo la legittimazione di un potere illimitato.
