Potere costituente e materialità della Costituzione, alla radice della forma Stato

The constituent power is intrinsically linked in its operation to the materiality inherent in civil society. Materiality that materializes in the dynamics of power and strength that are codified by law and by the constitutional text when it comes to giving rise to the form of State. More specifically, it is in work, elevated to a fundamental principle in the Italian Constitution, that all the dynamics that give legitimacy to the actions of the constituent power can be found. Through this paper we have attempted, through legal texts by eminent jurists and other legal scientists, to give a political philosophical point of view of the constituent dynamics.

Il potere costituente è intrinsecamente legato nel suo operare alla materialità insita nella società civile. Materialità che si concretizza nelle dinamiche di potere e di forza che vengono codificate dal diritto e dal testo costituzionale quando si tratta di dare origine alla forma Stato. Più nello specifico è nel lavoro, elevato nella Costituzione italiana a principio fondamentale, che si possono riscontrare tutte le dinamiche che danno legittimità all'agire del potere costituente. Tramite questo elaborato si è cercato, attraversando testi giuridici di insigni giuristi e altri scienziati del diritto, di dare un punto di vista filosofico politico della dinamica costituente.
