The incursion of the COVID-19 pandemic posed a series of unprecedented challenges to the Italian legal system, raising crucial questions about the balance between fundamental rights. This thesis focuses on analyzing the delicate balance between the right to movement and the right to health in Italy during the pandemic period. Through a detailed investigation of the emergency legislative framework, consisting of decrees, ordinances and laws, it explores how Italian authorities sought to mitigate the spread of the virus by significantly restricting citizens' freedom of movement. The analysis reveals that although the restrictive measures were generally justified by the need to protect public health, they also raised legitimate concerns about the proportionality and subsidiarity of the restrictions imposed. The thesis argues that balancing the right to movement and the right to health in a health emergency context is one of the most complex and challenging legal issues of our time. It also offers a series of recommendations on how to improve the regulatory framework to address future health crises, emphasizing the importance of a holistic approach that takes into account both public health needs and individual freedoms.
L'irruzione della pandemia di COVID-19 ha posto una serie di sfide senza precedenti al sistema giuridico italiano, sollevando questioni cruciali sul bilanciamento tra diritti fondamentali. Questa tesi si concentra sull'analisi del delicato equilibrio tra il diritto alla circolazione e il diritto alla salute in Italia durante il periodo pandemico. Attraverso un'indagine dettagliata del quadro legislativo emergenziale, composto da decreti, ordinanze e leggi, si esplora come le autorità italiane abbiano cercato di mitigare la diffusione del virus limitando significativamente la libertà di movimento dei cittadini. L'analisi rivela che, sebbene le misure restrittive siano state generalmente giustificate dalla necessità di proteggere la salute pubblica, esse hanno anche suscitato preoccupazioni legittime riguardo alla proporzionalità e alla sussidiarietà delle restrizioni imposte. La tesi argomenta che il bilanciamento tra il diritto alla circolazione e il diritto alla salute in un contesto di emergenza sanitaria rappresenta una delle questioni giuridiche più complesse e sfidanti del nostro tempo. Offre, inoltre, una serie di raccomandazioni su come migliorare il quadro normativo per affrontare future crisi sanitarie, sottolineando l'importanza di un approccio olistico che tenga conto sia delle esigenze di salute pubblica che delle libertà individuali.
