The thesys will address the worker's negligence in those cases in which their behaviour is so reckless and abnormal, while carrying out the tasks they were charged with or others that were not included in these activities, that the employer could not have foreseen it. In particular, it will define the roles snd obligations of both the employer and the worker. Subsequently, the focus will be on examining the orientation of jurisprudence and the point of view of doctrine on this issue, and finally, a case study will be discussed.
Nella tesi si affronterà la colpa del lavoratore, nei casi in cui ponga in essere un comportamento talmente imprudente, negligente e imperito, nello svolgimento delle proprie mansioni o di mansioni che non rientravano nella sua sfera di attività, che il datore di lavoro non avrebbe potuto prevedere. In particolare si tratterà di definire il ruolo e gli obblighi sia del datore che del lavoratore, poi si passerà all'orientamento della giurisprudenza e alle considerazione della dottrina e infine si affronterà un caso giurisprudenziale.
