Il licenziamento per superamento del periodo di comporto e per sopravvenuta inidoneità

The thesis has the objective of analyzing the institutions of the period of conduct and of the subsequent unsuitability, trying to delve into for each institution all the different problems that can affect an employer who finds himself facing an unsuitability for the specific job or perhaps a succession of illnesses of one of your employees, which causes the duty period to be exceeded. An attempt was also made to delve deeper into the repercussions that affected both institutes following the entry into force in our legal system of the broad notion of community-based "handicap".

La tesi ha l'obiettivo di analizzare gli istituti del periodo di comporto e della sopravvenuta inidoneità, cercando di approfondire per ciascun istituto tutte le diverse problematiche che possono investire un datore di lavoro che si trova ad affrontare l'inidoneità alla mansione specifica o magari il susseguirsi di malattie, di un proprio dipendente, che determinino il superamento del periodo di comporto. Si è cercato di approfondire anche le ripercussioni che hanno investito entrambi gli istituti a seguito dell'entrata in vigore nel nostro ordinamento della nozione ampia di "handicap" di matrice comunitaria.
