This thesis work discusses the importance of the notion of family reunification, a topic heavily addressed in the USA but very little in Italy. We intend to think about the importance of preserving the bond between an estranged minor and his family of origin, reconceptualizing the term family reunification. The objective of family reunification is to re-establish a healthy and loving family environment, where what is preferred is not negligence on the part of the parent towards their child but a good bond of care and continuous well-being. When we talk about minors temporarily removed from their home, we mean children who suffer neglect (thought of as irreparable) by their parents. For this reason, minors are deprived of the right to remain with their family, since the latter is no longer considered suitable to carry out the role of responsible parent. What is not taken into consideration (and which is certainly essential) is that the most fragile families have an extreme need to be supported and accompanied on a path of parental responsibility, in which they learn the art of empathy, listening , reciprocity and respect. Depriving them of their children is like depriving them of being hopeful for a future together with them. It must be underlined that considering families during family reunification processes means thinking of them as a primary investment, since they have everything they need to guarantee the well-being of their child. Giving them trust can be a first step towards re-creating that lost bond. An important figure is Anthony Maluccio, professor at Boston University, who together with his collaborators formulates a more inclusive and less invasive approach to the topic of family reunification: according to him, the objective of the latter is not to reunite children with their families biological but to strengthen the bond between them, even if they do not live together. The aim becomes to help families and minors away from home to maintain a certain type of connection: from total or partial return to periodic meetings. The ultimate goal is always the well-being of the child which also implies the "feeling good" of the family unit.
Il presente lavoro di tesi ragiona sull'importanza della nozione di riunificazione familiare, tema fortemente affrontato negli Usa ma ben poco in Italia. Si intende ragionare sull’importanza di preservare il legame tra minore allontanato e la sua famiglia d’origine, riconcettualizzando il termine di riunificazione familiare. L'obiettivo della riunificazione familiare è quello di ristabilire un ambiente familiare sano e amorevole, dove a prediligere non è la negligenza da parte del genitore nei confronti del proprio figlio ma un buon legame di cura e benessere continuo. Quando si parla di minori temporaneamente allontanati dal proprio nucleo d’origine, si intende parlare di bambini che subiscono trascuratezze (pensate come irreparabili) da parte dei genitori. Per tale motivo i minori vengono tolti di diritto a rimanere con la propria famiglia, poiché quest’ultima non è ritenuta più idonea nello svolgere la mansione di genitore responsabile. Ciò che invece non si prende in considerazione (e che sicuramente è essenziale) è che le famiglie più fragili hanno un estremo bisogno di essere sostenute e accompagnate in un percorso di responsabilizzazione genitoriale, nel quale imparano l’arte dell’empatia, dell’ascolto, della reciprocità e del rispetto. Privarle dei propri figli è come privarle di essere speranzose per un futuro insieme ad essi. Bisogna sottolineare che considerare le famiglie durante i processi di riunificazione familiare significa pensarle come un investimento primario, poiché hanno tutto ciò che serve per garantire il benessere del proprio figlio. Dare loro fiducia può essere un primo passo per avvicinarsi a ri-creare quel legame perduto. Importante la figura di Anthony Maluccio, professore alla Boston University, che insieme ai suoi collaboratori formula in un approccio più inclusivo e meno invasivo del tema della riunificazione familiare: secondo lui, l’obiettivo di quest’ultima non è ricongiungere i bambini alle loro famiglie biologiche ma di rafforzare il legame tra di loro, pur non vivendo insieme. Lo scopo diventa aiutare le famiglie e i minori fuori casa a mantenere un certo tipo di connessione: dal rientro totale, parziale agli incontri periodici. Il fine ultimo è sempre il benessere del bambino che implica anche lo “stare bene” del nucleo familiare.
