The present thesis seeks to analyze the case currently before the International Court of Justice, which was asked to formulate an advisory opinion by the UN General Assembly regarding the legal, political and practical consequences of Israel's conduct in the Occupied Palestinian Territories. This is an ongoing trial, therefore, the intent is to present the questions identified and illustrated by the States through written and oral statements, in such a way as to be able to hypothesize the obligations that, on a purely legal level, would arise for Israel, the international community and the UN, as prescribed by international law. Therefore, in the first chapter, the topic will be introduced by retracing the fundamental stages which, nowadays, lead us to discuss the occupation of Palestine. Thereafter, the following three parts of the paper will study the two questions posed to the Court in detail, with a specific focus on the competence of the judicial body in the present case, the right to self-determination of the Palestinian people, along with its related implications, and, finally, the possible legal effects of the practices implemented by the Israeli authorities. To conclude, the last chapter will attempt to elaborate an answer to the double interrogatives, reflecting on what was argued by both sides of the trial and, above all, on the usefulness of an opinion from the Court on the matter, also based on past rulings.
La presente tesi si propone di analizzare il caso correntemente dinanzi alla Corte Internazionale di Giustizia, alla quale è stata richiesta la formulazione di un parere consultivo da parte dell'Assemblea Generale dell'Onu circa le conseguenze legali, politiche e pratiche della condotta di Israele nei Territori Palestinesi Occupati. Si tratta di un giudizio tuttora in corso, perciò, quanto si intende fare è presentare le domande rilevate ed esposte dagli Stati tramite interventi scritti e orali, in modo tale da poter ipotizzare le obbligazioni che, sul piano puramente giuridico, deriverebbero in capo ad Israele, alla comunità internazionale e all'Onu secondo quanto prescritto dal diritto internazionale. Pertanto, nel primo capitolo si cercherà di introdurre all'argomento ripercorrendo le tappe fondamentali che, ad oggi, ci portano a discutere di una condizione di occupazione in Palestina. Dopodiché, nelle successive tre parti dell'elaborato i due quesiti posti alla Corte verrano studiati in modo dettagliato, con un focus specifico sulla competenza dell'Organo giudiziario nel caso di specie, il diritto all'autodeterminazione del popolo palestinese, congiuntamente alle relative implicazioni, e, infine, i possibili effetti legali delle pratiche poste in essere dalle autorità israeliane. Per concludere, l'ultimo capitolo tenterà di ricavare una risposta al doppio interrogativo, riflettendo su quanto argomentato da entrambe le parti del processo e, soprattutto, sull'utilità di un'opinione della Corte in merito, anche sulla base delle pronunce passate.
