This research focuses on the analysis of legal cases in Spain and Italy within the "Renewable Energy Saga," examining fourteen key arbitral awards to identify contentious issues and assess their impact on the subsequent practices of the involved states. Particular attention is given to the application of the principle of fair and equitable treatment, as defined in Article 10, paragraph 1, of the Energy Charter Treaty (ECT), which lacks a universally accepted definition and is thus interpreted and applied by arbitral tribunals based on the specific terms and conditions of the relevant treaties. By identifying common points across the various awards, this study evaluates the tangible impact of these legal developments on the decisions of states regarding the content of the most recent international investment agreements, highlighting the most pertinent articles. The findings suggest that the arbitral awards in the Renewable Energy Saga have significantly influenced the practices of not only Spain and Italy but also third-party states.
Questo lavoro di ricerca analizza casi giuridici in Spagna e Italia relativi alla "Saga delle Energie Rinnovabili", esaminando quattordici sentenze arbitrali per identificare punti controversi e valutarne l'impatto sulla prassi degli Stati coinvolti. Particolare attenzione è rivolta all'applicazione del principio di trattamento giusto ed equo, come definito nell'Articolo 10, paragrafo 1, dell'Energy Charter Treaty (ECT), interpretato variamente dai tribunali arbitrali in base ai termini e alle condizioni contenute nei trattati pertinenti, ove presenti. L'analisi comparativa delle sentenze permette di valutare l'influenza concreta di queste decisioni sulle recenti scelte degli Stati in merito agli accordi sugli investimenti internazionali, evidenziando gli articoli più rilevanti. La conclusione è che le sentenze arbitrali nella Saga delle Energie Rinnovabili hanno significativamente influenzato la prassi non solo di Spagna e Italia, ma anche di altri Stati.
