L’assegnazione temporanea del genitore dipendente pubblico nel Testo unico sulla tutela della maternità e paternità

It analyzes the institution of the temporary assignment of the public servant parent pursuant to art.42-bis, d.lgs. n.151/2001 focusing on the legal nature of the institution and on the problems of interpretation of the legislative provision in recent jurisprudence. Attention will be paid to the requirements required by the parent and also those of the minor child in order to be able to request temporary assignment and to the situations in which this can be denied.

Viene analizzato l’istituto dell’assegnazione temporanea del genitore dipendente pubblico ex art.42-bis, d.lgs. n.151/2001 soffermandosi sulla natura giuridica dell’istituto e sulle problematiche interpretative della disposizione legislativa nella giurisprudenza recente. Verrà posta attenzione ai requisiti richiesti al genitore e anche a quelli del figlio minore per poter richiedere l’assegnazione temporanea e alle situazioni in cui questa può essere negata.
