Throughout history, humanity has continually sought ways to automate work, and this extends to professions requiring expertise. The latest technological advancements have led to sophisticated artificial intelligence systems that can assist legal professionals (lawyers, judges, bailiffs, court clerks, technical consultants, notaries) in performing certain activities. The use of artificial intelligence has opened unprecedented scenarios and raised delicate issues, prompting lawmakers to establish new rules, whose long-term viability is, however, currently difficult to assess. We are still in an embryonic phase of legislation, which will likely require further integration and adjustments. This thesis addresses these topics, particularly in relation to the traditional role of the civil lawyer, which is significantly impacted using legal assistance software and platforms by both the lawyer and potential clients. The aim is to provide an overview of how the legal profession is rapidly changing, highlighting the legal and ethical implications associated with these momentous changes.
Nel corso della storia l’uomo ha continuamente cercato la via dell’automazione del lavoro e questo vale anche per il settore delle professioni che richiedono una particolare expertise. Le ultime avanguardie tecnologiche hanno portato a sofisticati sistemi di intelligenza artificiale, che possono assistere pure il professionista legale (l’avvocato, il giudice, l’ufficiale giudiziario, il cancelliere, il consulente tecnico, il notaio) nello svolgimento di determinate attività. L’utilizzo dell’intelligenza artificiale ha aperto scenari inediti e sollevato problemi delicati, che hanno indotto il legislatore a dettare nuove regole, la cui tenuta nel lungo periodo è però difficile al momento valutare. Siamo in una fase ancora embrionale della legislazione, che richiederà probabilmente integrazioni e assestamenti. La Tesi tratta di questi temi rapportati in particolare al ruolo tradizionalmente svolto dall’avvocato civilista, sul quale impatta in maniera incisiva l’utilizzo dei software e delle piattaforme di assistenza legale di cui lui stesso o il potenziale cliente si può avvalere. Lo scopo è quello di fornire una panoramica su come la professione forense stia rapidamente cambiando, sottolineando le implicazioni legali ed etiche correlate a questi epocali mutamenti.
