La prova del D.N.A. nei processi penali in Inghilterra e negli Stati Uniti negli ultimi decenni del Novecento

This thesis proposes a study of the advent of D.N.A. testing and its use in criminal proceedings in England and the United States of America in the last decades of the Twentieth century. Initially, it suggests a brief overview from Mendel's laws of genetics to the discovery of the new technology by Alec Jeffreys. It then discusses the various technological developments of DNA testing that occurred in the following years, focusing on the applicability of the new technique in forensic matters. This will allow the understanding of the importance of DNA testing, how it has developed, and what positive features it has brought to the courtroom. Criminal cases that have been solved thanks to the test and, above all, legal battles will be analyzed. Finally, topics related to the creation of databases useful for the recognition and search of persons will be addressed, with particular reference to the phenomenon of recidivism. The piece of work concludes by briefly discussing the potential errors that can be made during analyses, demonstrating how DNA testing – often considered a "perfect" technique – can prove to be weak in certain scenarios.

In questa tesi si propone uno studio dell’avvento del test del D.N.A. e del suo utilizzo nei processi penali in Inghilterra e negli Stati Uniti d’America negli ultimi decenni del Novecento. Inizialmente si propone un breve excursus dalle leggi della genetica di Mendel fino ad arrivare alla scoperta della nuova tecnologia da parte di Alec Jeffreys. Si discute, quindi, dei vari sviluppi tecnologici del test del D.N.A. avvenuti negli anni successivi, soffermandosi sulla applicabilità della nuova tecnica in materia forense. Questo permetterà di capire l’importanza del test del D.N.A., come si è sviluppato e quali caratteristiche positive ha portato nelle sedi giudiziarie. Si analizzeranno casi criminali che hanno trovato risposta grazie al test e soprattutto battaglie legali. Verranno trattati, infine, temi riguardanti la nascita delle banche dati utili al riconoscimento ed alla ricerca di persone, con particolare riferimento al fenomeno della recidiva. L’elaborato si conclude trattando, in sintesi, i potenziali errori che possono essere commessi durante le analisi, dimostrando come il test del D.N.A. – spesso considerato una tecnica “perfetta” – possa risultare debole in taluni scenari.
