Starting from an examination of the enormous changes that have taken place in the field of the legal regulation of inventions in the international context, especially with reference to the influence that French legislation had on the Italian reality, this thesis aims to analyze, in its historical and legal dynamics, the regulation of patents and technological inventions in Italy during the 19th century: from the discipline in the preunitary states, characterized by a thinking still tied to the past, to the Unification of Italy, when the need for a new mentality was felt. In particular, the thesis focuses attention on the Industrial Property Law of 1859, a pillar of Italian legislation, with which the system of privileges was abandoned and a more modern line in step with the times was adopted. To conclude, the thesis analyzes discussions and issues that emerged in the late 19th century through the studies of jurist Edoardo Bosio, who highlights the gaps and imperfections present in the Italian regulatory system, characterized by the slowness of legislative procedures compared to the technological progress that was developing in that historical period.
Partendo dall'esame degli enormi cambiamenti avvenuti nel campo della disciplina giuridica delle invenzioni nel contesto internazionale, soprattutto con riferimento all'influenza che ha avuto la legislazione francese nella realtà italiana, questa tesi ha come obiettivo quello di analizzare, nelle sue dinamiche storiche e giuridiche, la regolamentazione dei brevetti e delle invenzioni tecnologiche in Italia durante l'Ottocento: dalla disciplina negli Stati preunitari, caratterizzati da un pensiero ancora legato al passato, fino all'Unità d'Italia, quando si avverte la necessità di una nuova mentalità. In particolar modo, la tesi focalizza l'attenzione sulla Legge sulle privative industriali del 1859, pilastro della legislazione italiana, con la quale si abbandona il sistema dei privilegi e si adotta una linea più moderna e al passo coi tempi. Infine, la tesi analizza dibattiti e questioni emersi a fine Ottocento attraverso gli studi del giurista Edoardo Bosio, che evidenzia le lacune e le imperfezioni presenti nel sistema normativo italiano, caratterizzato dalla lentezza delle procedure legislative rispetto al progresso tecnologico che si va sviluppando in quel periodo storico.
