The article 34 of the Constitution refers to education and asserts that only the capable and meritorious, even if they do not have economic means, have the right to higher education. This article introduces, therefore, the concept of meritocracy, which is very complex and difficult to evaluate. The Italian system often uses various methods to select the meritorious. But does merit in school, as expressed in the Constitution, generate competition among students? This question is important, especially since many students have begun to talk about competitiveness in education, especially following the numerous suicides among university students in recent years. Capability and merit are necessary criteria to ensure that students without economic means can attend university. However, there is a problem in that, on the one hand, the article acknowledges that all capable and meritorious individuals have the right to higher education even if they do not have economic means, but on the other hand, scholarships are awarded through competition, which could undermine the right to education due to a lack of financial resources. The aim is to investigate article 34, how it is interpreted, and how the right to education is effectively implemented, striving to understand if merit in education could generate strong competitiveness.
L’articolo 34 della Costituzione fa riferimento all’istruzione e sostiene che solo i capaci e meritevoli, anche se non hanno le possibilità economiche, hanno diritto all’istruzione superiore. Questo articolo introduce, quindi, il concetto di meritocrazia che è molto complesso e difficile da valutare. L’ordinamento italiano, infatti, utilizza spesso vari metodi per selezionare i meritevoli. Ma il merito nella scuola, così come è espresso in Costituzione, genera competizione tra gli studenti? Questa domanda risulta importante soprattutto da quando molti studenti hanno iniziato a parlare di competitività nell’istruzione, specialmente a seguito dei numerosi suicidi tra gli universitari negli ultimi anni. Capacità e merito sono criteri necessari per far sì che gli studenti privi delle possibilità economiche possano frequentare l’università. Tuttavia è presente una problematicità dal momento in cui da un lato l’articolo riconosce che tutti i capaci e meritevoli hanno diritto all’istruzione superiore anche se non hanno le possibilità economiche, ma dall’altro lato le provvidenze sono assegnate per concorso e questo potrebbe far venire meno, a causa di una mancanza di fondi economici, il diritto allo studio. Lo scopo è quello di indagare l’art 34, come esso viene interpretato e come viene reso effettivo il diritto all’istruzione, sforzandoci di comprendere se il merito nell’istruzione genera competitività.
