Restorative justice, as an innovative paradigm, offers an opportunity to rethink social fractures by giving the possibility to open new paths, not only in the criminal justice system but also in the civil, relational and social spheres. Considering the recent origins of Restorative justice, the aim of this paper is to determine how it intends to support the process of reeducation and empowerment of the offender; what contribution the offender can offer in the reconciliation of the broken ties among the parties; how the victim is valued; and what support the educator can offer during the reeducative process. This paper intends to investigate the different fields of application of Restorative Justice, primarily with a historical approach through literature review, and secondarily to a field research in order to better explore the approach. This second analysis will be supported by interviews with actors who use the construct in order to repair broken community ties.
La Giustizia riparativa, intesa come paradigma innovativo, offre un’occasione per ripensare le fratture sociali dando la possibilità di aprire nuove strade, non soltanto nel sistema penale ma anche nell’ambito civile, relazionale e sociale. Considerando le recenti origini della Giustizia riparativa, l’obiettivo di questo lavoro è quello di verificare in quale modo essa intende supportare il processo di rieducazione e responsabilizzazione dell’autore di reato; quale contributo può offrire nella riconciliazione dei legami interrotti tra le parti; in che modo la vittima viene valorizzata e qual è il supporto che l’educatore può dare durante il processo rieducativo. Questo elaborato intende indagare i diversi campi di applicazione della Giustizia riparativa partendo da un approccio storico attraverso una rielaborazione della letteratura, sino ad arrivare ad una ricerca sul campo per poter meglio esplorare l’approccio. Lo studio dello stesso sarà supportato da interviste agli attori che ne utilizzano il costrutto al fine di riparare i legami comunitari interrotti.
