La tutela giuridica del minore in comunità: dall'affermazione dei diritti alla prassi applicativa

The purpose of this thesis is to explore the issue of the protection of minors in the community. It starts from the definition of a minor as a subject of law, and then examines the norms related to its protection, both at the international and national levels. Next, it dwells on the different types of communities present in Italy, analyzing the different situations and "types" of minors received within them. Finally, we proceed with the analysis of a concrete case of a community, in order to verify whether the theoretical norms find effective application in reality.

La presente tesi si propone di approfondire il tema della tutela dei minori in comunità. Si parte dalla definizione di minore come soggetto di diritto, per poi esaminare le norme relative alla sua tutela, sia a livello internazionale che nazionale. Successivamente, ci si sofferma sulle diverse tipologie di comunità presenti in Italia, analizzando le differenti situazioni e le "tipologie" di minori accolti al loro interno. Infine, si procede con l'analisi di un caso concreto di comunità, al fine di verificare se le norme teoriche trovino effettiva applicazione nella realtà.
