La trasparenza amministrativa nell'era digitale

This thesis aims to address the issue of transparency in the digital age starting from the meaning of the term and then proceed with the historical-normative evolution of the law that led to the introduction of transparency in our legal system. This path will evolve starting from a political discourse and passing through the Constitution will then pass through Law 241/90, finally arriving at the Transparency Decree. The second chapter will be devoted entirely to the aspect of the technological evolution of the 21st century and how the law, especially that concerning transparency, combines today and how in the future it will have to deal with new algorithmic and artificial intelligence developments. In the third chapter the subject of public contracts will be taken into consideration because it is a first step towards positive law in the field of digitalisation, which will undoubtedly, as provided for in case-law, as an inspiring example for other matters of administrative law. I will then conclude this thesis by highlighting a very recent ruling that demonstrates how administrative law is constantly evolving even at the time this thesis was drafted.

Questa tesi ha l’obiettivo di affrontare il tema della trasparenza nell’era digitale a partire dal significato del termine per poi procedere con l’evoluzione storico-normativa del diritto che ha portato all’introduzione della trasparenza nel nostro ordinamento giuridico. Questo percorso si evolverà a partire da un discorso politico e che passando per la Costituzione attraverserà poi la legge 241/90, per giungere infine al Decreto Trasparenza. Il secondo capitolo sarà interamente dedicato all’aspetto dell’evoluzione tecnologica del XXI secolo e di come il diritto, in particolare quello che riguarda la trasparenza, si coniuga oggi e di come, in futuro, dovrà rapportarsi ai nuovi sviluppi algoritmici e dell’intelligenza artificiale. Nel terzo capitolo verrà presa in considerazione la materia dei contratti pubblici perché si tratta di un primo approdo di diritto positivo in materia di digitalizzazione, che servirà senz’altro, come previsto anche dalla giurisprudenza, come esempio ispiratore per le altre materie del diritto amministrativo. Concludo poi la tesi portando in luce una sentenza molto recente a dimostrazione di come il diritto amministrativo sia in continua evoluzione anche nel momento in cui questa tesi è stata elaborata.
