In this paper the following theses are supported and illustrated: T1 the European standardization bodies operating in the telecommunications sector have been put under unfair pressure by the European Commission on basis of "European sovereignty", a notion whose legal basis is not very clear; this can lead to very serious consequences, including excessive fragmentation (balkanization) of standards in the telecommunications sector, pushing the market to find alternative, non-European solutions for the formulation of standard. T2 the exclusion of ETSI from the drafting of the harmonized standards relating to the AI Act is critical, also in view of the impact that artificial intelligence has on networks 5G and future. T3 the promotion by the European Commission of competition in the sector of telecommunications, especially in those of mobile radio communication, has brought serious damage to the industrial system and the European telecommunications market, essentially undermining the ability of the European system to contribute to European standardization.
In questo elaborato si sostengono e illustrano le seguenti tesi: T1 gli enti di standardizzazione europei che operano nell’ambito delle telecomunicazioni sono stati messi sotto ingiusta pressione dalla Commissione Europea sulla base della “sovranità europea”, nozione la cui base giuridica non è molto chiara; ciò può portare a conseguenze molto serie, tra cui la frammentazione eccessiva (balcanizzazione) degli standard nell’ambito delle telecomunicazioni, spingendo il mercato a trovare soluzioni alternative, non europee, per la formulazione degli standard. T2 l’esclusione di ETSI dalla redazione degli standard armonizzati relativi all’AI Act risulta critica, anche in vista dell’impatto che l’intelligenza artificiale ha sulle reti 5G e future. T3 la promozione da parte della Commissione Europea delle concorrenza nel settore delle telecomunicazioni, specialmente in quelle di comunicazione radiomobile, ha portato seri danni al sistema industriale e al mercato europeo delle telecomunicazioni, minando nella sostanza la capacità del sistema europeo di contribuire alla standardizzazione europea.
