The thesis develops the theme of the Mounts of piety, credit financing institutions that had their roots in central Italy in the 15th century. The institute presented the structural characteristics and professionalism typical of banking activity, but also contained a charitable purpose which emerged in the conditions for granting loans which were considered particularly advantageous compared to alternative Jewish pawnshops. However, the application of a interest rate on the loan led the Mounts of piety to be accused of usury by their detractors. Consequently, a series of consilia were drawn up by the jurists of the time aimed at defending the new institution and legitimizing, according to ecclesiastical canons, the interest applied. This paper examines the consilium of Annio da Viterbo who in his work entitled "Questiones due disputate super mutuo iudaico et civili et divino" reported with meticulous rigor the main motivations in support of this institution, which will be demonstrated not only to be devoid of no profit-making desire, but also being indispensable for the realization of the common good in cities.
L'elaborato sviluppa il tema dei Monti di Pietà, istituti di finanziamento del credito che posero le radici nell’Italia centrale del XV secolo. L’istituto presentava le caratteristiche strutturali e la professionalità tipica dell’attività bancaria racchiudendo, però, una finalità caritativa che emerse nelle condizioni di concessione dei prestiti considerate particolarmente vantaggiose rispetto agli alternativi banchi di pegno ebraici. Tuttavia, proprio l'applicazione di un tasso di interesse sul prestito benché esiguo, portò i Monti di pietà ad essere accusati di usura dai loro detrattori. Vennero, così, elaborati una serie di consilia da parte dei giuristi dell’epoca volti a difendere la nuova istituzione e a legittimare, secondo i canoni ecclesiastici, l'interesse applicato. Nell'elaborato viene, in particolar modo, esaminato il consilium di Annio da Viterbo in cui nella sua opera “Questiones due disputate super mutuo iudaico et civili et divino” riportò con meticoloso rigore le principali motivazioni a sostegno di tale istituzione, la quale risulterà non solo priva di alcuna volontà lucrativa, ma anche indispensabile per la realizzazione del bene comune nelle città.
