La richiesta di misure urgenti nel caso Nicaragua c. Germania davanti alla Corte Internazionale di Giustizia.

This thesis will show how a case before the International Court of Justice unfolds, specifically the case of Nicaragua's request for urgent measures against Germany for alleged violations of international obligations. Nicaragua accuses Germany not only of failing to prevent, but also of contributing to the genocide taking place in Palestine at the hands of Israel by supplying weapons and military equipment to Israel and by suspending funds to UNRWA, a UN agency that makes a vital contribution to the Palestinians. In doing so, according to Nicaragua, Germany would be violating various international obligations, originating from both Conventions and general international law, and therefore appeals to the International Court of Justice to demand that Germany cease its unlawful conduct and that urgent interim measures must be taken to counter its support for Israel. However, Germany rejects the charges and states that it does not contribute in any way to the situation in Palestine, that it has decreased arms supplies for Israel after October 7 and that it has resumed funding to UNRWA. It then asks the Court not to approve Nicaragua's request for urgent measures. The Court, after hearing the Parties in two separate public hearings, rejects Nicaragua's request, while remarking what are the States' international obligations in the case of a "plausible" genocide.

La tesi andrà a trattare come si svolge un caso davanti alla Corte Internazionale di Giustizia, in particolare il caso di richiesta di misure urgenti da parte del Nicaragua nei confronti della Germania per delle presunte violazioni di obblighi internazionali. Il Nicaragua, infatti, accusa la Germania non solo di non essere stata in grado di prevenire, ma anche di contribuire al genocidio che si sta consumando in Palestina per mano di Israele, fornendo armi ed equipaggiamenti militari a Israele e sospendendo i fondi destinati all'UNRWA, agenzia delle Nazioni Unite che dona un contributo fondamentale ai Palestinesi. In questo modo, secondo il Nicaragua, la Germania starebbe violando diversi obblighi internazionali, derivanti sia da Convenzioni che dal diritto internazionale generale e per questo si appella alla Corte Internazionale di Giustizia per richiedere che la Germania cessi la sua condotta illecita e che vengano prese delle misure provvisorie urgenti per contrastare il suo sostegno a Israele. Tuttavia, la Germania rigetta le accuse e dichiara di non contribuire in alcun modo alla situazione in Palestina, di aver diminuito il rifornimento di armi per Israele dopo il 7 ottobre e di aver ripreso i finanziamenti all'UNRWA. Chiede quindi alla Corte di non approvare la richiesta di misure urgenti del Nicaragua. La Corte, dopo aver sentito le Parti in due diverse udienze pubbliche, rifiuta la richiesta del Nicaragua, pur rimarcando quelli che sono gli obblighi internazionali degli Stati nel caso di un "plausibile" genocidio.
