LA TUTELA DEI MINORI STRANIERI NON ACCOMPAGNATI NEL SISTEMA D’ASILO DELL’UNIONE EUROPEA ALLA LUCE DEL NUOVO PATTO SU MIGRAZIONE E ASILO. IL CASO ITALIANO.

The topic of this paper will be the protection of unaccompanied foreign minors within the European Union asylum system. Starting with the Dublin III regulation, it will analyze what have been the problems and critical issues of that system with reference to the situation of unaccompanied foreign minors. Next, we will focus on the Italian case, which appears to be particularly significant and beyond critical. Finally, the recent European Pact on Migration and Asylum, approved in 2024, will be examined, defining what updates on the subject it has made and reflecting on any steps forward in the protection of these individuals, as well as whether these are sufficient to guarantee them adequate and effective protection.

L’argomento di questo scritto sarà la tutela dei minori stranieri non accompagnati all’interno del sistema d’asilo dell’Unione Europea. A partire dal regolamento Dublino III si analizzerà quali sono state le problematiche e le criticità di tale sistema con riferimento alla situazione dei minori stranieri non accompagnati. Successivamente, ci si concentrerà sul caso italiano, che risulta essere particolarmente significativo e oltremodo critico. Infine, si esaminerà il recente Patto europeo su migrazione e asilo, approvato nel 2024, definendo quali aggiornamenti in materia abbia apportato e riflettendo su eventuali passi avanti nella tutela di questi soggetti, nonché se questi siano sufficienti per garantire loro un’adeguata ed effettiva protezione.
