Family mediation is increasingly becoming a crucial tool for managing disputes within the family context, providing support for conflict resolution. This thesis aims to examine and compare the approach to family mediation in the Italian and French legal systems. Through a comparative analysis, we will explore the similarities and differences in the legal frameworks, fundamental principles, procedures and results of family mediation in both countries. In the Italian context, family mediation is the subject of recent measures that regulate its implementation and promote its use as a fundamental tool for the resolution of family disputes. On the other hand, in France, family mediation has experienced significant growth in recent decades, with the adoption of specific laws governing its practice.. Through the comparative study of regulations, practices and results obtained in the two contexts, this thesis aims to provide a complete overview of the challenges and opportunities present in family mediation. We will also examine the cultural, social and legal implications that affect the effectiveness and accessibility of family mediation in Italy and France, with the aim of identifying best practices and suggesting possible improvements in their respective legal systems.
La mediazione familiare si configura sempre più come uno strumento cruciale per la gestione delle controversie all'interno del contesto familiare, offrendo un supporto alla risoluzione dei conflitti. Questa tesi si propone di esaminare e confrontare l'approccio alla mediazione familiare nei sistemi giuridici italiano e francese. Attraverso un'analisi comparativa, si esploreranno le similitudini e le differenze nei quadri giuridici, nei principi fondamentali, nei procedimenti e nei risultati della mediazione familiare in entrambi i paesi. Nel contesto italiano, la mediazione familiare è oggetto di recenti provvedimenti che ne regolamentano l'attuazione e ne promuovono l'utilizzo come strumento fondamentale per la risoluzione delle controversie familiari. D'altro canto, in Francia, la mediazione familiare ha sperimentato una crescita significativa negli ultimi decenni, con l'adozione di leggi specifiche che ne disciplinano la pratica. Attraverso lo studio comparativo delle normative, delle prassi e dei risultati ottenuti nei due contesti, questa tesi mira a fornire una panoramica completa delle sfide e delle opportunità presenti nella mediazione familiare. Si esamineranno inoltre le implicazioni culturali, sociali e legali che influenzano l'efficacia e l'accessibilità della mediazione familiare in Italia e in Francia, con l'obiettivo di individuare best practice e suggerire possibili miglioramenti nei rispettivi sistemi giuridici.
