The following dissertation offers a reflection on the discipline of the phenomenon of voluntary mobility in public employment, pursuant to art. 30 of Legislative Decree n. 165/2001. The main objective of the c.d. direct transfer of personnel between different administrations is to encourage a better allocation of human resources also in order to ensure the containment of public spending. The analysis begins with a reconstruction of the dynamic regulatory framework that revolves around the institute of mobility, up to the most recent changes introduced since the decree "recruitment" of 2021. The survey continues with a deepening of the issue of the consent required to implement mobility and then ends with an examination of the effects and repercussions of the transition on the employment relationship of the public employee transferred.
Con il presente elaborato si vuole offrire una riflessione sulla disciplina del fenomeno della mobilità volontaria nel pubblico impiego, di cui all’art. 30 del d.lgs. n. 165/2001. Obiettivo principe del c.d. passaggio diretto di personale tra amministrazioni diverse è quello di favorire una migliore allocazione delle risorse umane anche al fine di garantire il contenimento della spesa pubblica. L’analisi inizia con una ricostruzione del dinamico quadro normativo che ruota attorno all’istituto della mobilità, sino alle più recenti modifiche introdotte a partire dal decreto “reclutamento” del 2021. L’indagine continua con un approfondimento della tematica del consenso richiesto per attuare la mobilità per poi concludersi con l’esame degli effetti e delle ripercussioni del passaggio sul rapporto di lavoro del dipendente pubblico trasferito.
