The subject of analysis of this research paper is the institute of nullity for violation of mandatory rules pursuant to Article 1418 of the Civil Code, with specific reference to banking contracts. In particular, this paper aims to understand whether the 'banking nature' of a contract is or is not an element capable of influencing the assessment of virtual nullity. To this end, we will first review the main doctrinal theories and the most relevant jurisprudential orientations regarding virtual nullity; subsequently, we will seek to identify and analyze the peculiar characteristics of the banking system that may reflect on the assessment of virtual nullity. Finally, after specifically defining what is meant by a banking contract, we will verify whether the 'banking nature' of the contract is or is not capable of influencing the assessment of nullity pursuant to Article 1418 of the Civil Code.
Oggetto di analisi del presente elaborato di ricerca è l'istituto della nullità per violazione di norme imperative ai sensi dell'art. 1418 c.c., con specifico riferimento ai contratti bancari. In particolare, il presente scritto ha come scopo ultimo quello di comprendere se la "bancarietà" di un contratto sia o meno un elemento idoneo a influenzare il giudizio di nullità virtuale. A tal fine, dapprima si darà conto delle principali teorie dottrinali e dei più rilevanti orientamenti giurisprudenziali in tema di nullità virtuale; successivamente, si cercherà di individuare e analizzare le caratteristiche peculiari dell'ordinamento bancario idonee a riflettersi sul giudizio di nullità virtuale. Infine, dopo aver definito specificamente cosa si intende per contratto bancario, si procederà a verificare se la "bancarietà" del contratto sia o meno in grado di influenzare il giudizio di nullità ex art. 1418 c.c.
