The dissertation examines in depth the disciplinary procedure in public employment, with particular attention to the procedural stages established by Legislative Decree 165/2001, which regulates the personnel management in public administrations, specifying the methods and timing for the initiation, conduct and conclusion of disciplinary proceedings. In the first part of the dissertation, the disciplinary power and responsibility are considered, and the various stages of the disciplinary procedure are analysed, from the notification of the charge to the communication of the sanction. In this chapter I’m exploring the criteria for assessing the seriousness of offences and possible sanctions, as well as the safeguards provided for the employee during the procedure. Subsequently, the dissertation focuses on the comparison between two specific areas of public employment: the Local Police (specifically the Municipality of Venice) and the State Police. For the Local Police, the provisions of the internal disciplinary code and the relevant CCNL, which regulate offences and sanctions specific to this body, are analysed. The peculiarities of the internal disciplinary rules are examined, as well as the procedures for ascertaining and applying sanctions. For the State Police, on the other hand, the thesis delves into the specific regulations (in particular D.P.R. 737/1985) and the national collective labour agreements (CCNL) governing the disciplinary procedure. The aim is to highlight the procedural and regulatory differences between the two police forces, providing a detailed overview of their disciplines and their implications. It will explore how different regulations and respective operational contexts influence the application of disciplinary sanctions.
La tesi esamina in modo approfondito il procedimento disciplinare nel pubblico impiego, con particolare attenzione alle fasi procedurali stabilite dal Decreto Legislativo 165/2001, quadro normativo di riferimento per la gestione del personale nelle amministrazioni pubbliche, specificando le modalità e le tempistiche per l'avvio, lo svolgimento e la conclusione dei procedimenti disciplinari. Nella prima parte della tesi, si considerano il potere e la responsabilità disciplinare, vengono analizzate le varie fasi del procedimento disciplinare, dalla contestazione dell'addebito alla comunicazione della sanzione. Si esaminano i criteri di valutazione della gravità delle infrazioni e le possibili sanzioni, nonché le tutele previste per il dipendente durante l'iter procedurale. Successivamente, la tesi si concentra sul confronto tra due specifici ambiti del pubblico impiego: la Polizia Locale (nello specifico del comune di Venezia) e la Polizia di Stato. Per la Polizia Locale, si analizzano le disposizioni del codice disciplinare interno e il relativo CCNL, che regolano le infrazioni e le sanzioni specifiche per questo corpo. Si esaminano le peculiarità delle norme disciplinari interne, nonché le procedure di accertamento e di applicazione delle sanzioni. Per la Polizia di Stato, invece, la tesi approfondisce le normative specifiche (in particolare il D.P.R. 737/1985) e i contratti collettivi nazionali di lavoro (CCNL) che disciplinano il procedimento disciplinare. L'obiettivo è evidenziare le differenze procedurali e normative tra le due forze di polizia, offrendo una visione dettagliata delle loro discipline e delle relative implicazioni. Si esplorerà come le diverse normative e i rispettivi contesti operativi influenzino l'applicazione delle sanzioni disciplinari.
