Controperizia e controversia: gli istituti per il confronto tra Autorità competente e Operatore del Settore Alimentare nell'attività di Controllo Ufficiale

The counterexpertise and the dispute are 2 institutions regulated by D.lgs. 27/2021 and Regulation (EU) 625/2017. The counterexpertise is the expertise requested by one of the two parties in court, to contest that submitted by the other; in this case the two parties are the Competent Authority and the OSA (Food Industry Operator). This thesis focuses on the explanation of when counterexpertise can arise and in case of consequence the dispute and how they develop and end. An experimental part is also illustrated, with a balance sheet on the number of counter-investigations and/or disputes and how they were concluded in all the ASL’s in Veneto.

La controperizia e la controversia sono 2 istituti regolati dal D.lgs. 27/2021 e dal Regolamento (UE) 625/2017. Per controperizia si intende la perizia richiesta da una delle due parti in giudizio, per contestare quella presentata dalla controparte; in questo caso le due parti sono l'Autorità Competente e l'OSA (Operatore del Settore Alimentare). Questa tesi si focalizza sulla spiegazione di quando possono insorgere la controperizia e in caso di conseguenza la controversia e come si sviluppano e si concludono. Inoltre viene illustrata una parte sperimentale con un bilancio riguardante il numero di controperizie e/o controversie e come si sono concluse, in tutte le ASL del Veneto.
