L'emersione dei diritti umani nei giudizi arbitrali in materia di investimenti

The thesis examines the role of human rights in the legal framework of international investments. We will first examine the birth of these branches of international law, with their characteristics and their international instruments. Then we will analyze how from the consideration of two totally separate strands, an indissoluble connection between human rights and investments is being discovered. And how slowly the Bits are inserting clauses on respect for human rights. We will also focus on the case of the indigenous peoples, reporting on the sentences in which foreign investors were recalled for having applied investments in their lands without respecting human rights. The last part will deal with the arbitral judgments in this regard.

La tesi esamina il ruolo dei diritti umani nel quadro giuridico degli investimenti internazionali. Verrà prima esaminata la nascita di questi rami del diritto internazionale, con le loro caratteristiche e i loro strumenti internazionali. Poi analizzeremo come dalla considerazione di due filoni totalmente separati, si stia scoprendo un indissolubile collegamento tra i diritti umani e gli investimenti. E come pian piano i Bits stiano inserendo delle clausole sul rispetto dei diritti umani. Ci soffermeremo anche sul caso delle popolazioni indigene, riportando delle sentenze in cui veniva richiamati gli investitori stranieri per aver applicato degli investimenti nelle loro terre senza rispettare i diritti umani. L'ultima parte si occuperà dei giudizi arbitrali in merito a ciò.
