The evolution of the concept of health and safety in the workplace has led to a gradual increase in the responsibilities of safety guarantors. Occupational Health and Safety (OHS) has always been a critical issue in every work environment, as it concerns the protection of workers' lives and well-being. This thesis introduces the topic with a general overview of workplaces and the various legal sources, such as the Constitution, the Civil Code, the Consolidated Law on Occupational Safety, and the Penal Code. Subsequently, the positions of the different safety guarantors are examined, highlighting how these roles have evolved over time. Finally, the responsibilities placed on these subjects are analyzed, with particular emphasis on the employer, who plays a central role in managing safety. The aim of the thesis is to highlight the changes that have occurred in workplaces in terms of health and safety. We speak of change because, in the past, health and safety were often considered secondary aspects, limited to minimal protective measures. However, with the evolution of society, the economy, and technology, there has been a growing focus on workers' well-being and the need to prevent accidents and occupational diseases.
Evoluzione del concetto di salute e sicurezza nei luoghi di lavoro, con conseguente aumento delle responsabilità dei i garanti della sicurezza. L'SSL costituisce da sempre una tematica importante in ogni contesto lavorativo, poichè riguarda la protezione della vita e del benessere dei lavoratori. L'argomento oggetto di questa tesi è introdotto da una panoramica generale sui luoghi di lavoro e sulle diverse fonti normative quali la Costituzione, il Codice civile, il Testo Unico della sicurezza sul avoro e il Codice Penale. Successivamente, viene approfondito il tema delle diverse posizioni dei garanti delle sicurezza, evidenziando come tali ruoli siano cambiati nel tempo. Per concludere, vengono analizzate le responsabilità che incombono su questi soggetti in particolar modo sul datore di lavoro, figura centrale nella gestione della sicurezza. L'obiettivo della tesi è quello di mettere in evidenza i cambiamento avvenuti nei luoghi di lavoro in termini di salute e sicurezza. Si parla di cambiamento perchè, in passato, la salute e sicurezza erano spesso considerate aspetti secondari, ridotti a semplici misure di protezione minime. Tuttavia, con l'evoluzione della società, dell'economia e della tecnologia è stata spostata una crescente attenzione sul benessere dei lavoratori e sulla necessità di prevenire incidenti e malattie professionali.
