The thesis is based on two fundamental themes of labor law: the worker's illness and dismissal. Specifically, it aims to analyze dismissal for just cause carried out by the employer against the employee who, during the period of illness, engages in other activities, both work-related and non-work-related, thus violating the general duties of fairness and good faith, as well as the contractual obligations of diligence and loyalty, in addition to presuming the non-existence of the illness or jeopardizing the recovery.
La tesi si basa su due temi fondamentali del diritto del lavoro, la malattia del lavoratore e il licenziamento. Nello specifico si vuole analizzare il licenziamento per giusta causa attuato dal datore di lavoro verso il lavoratore che, durante il periodo di malattia, svolge altre attività, sia di tipo lavorativo sia extralavorativo, violando così i doveri generali di correttezza e buona fede e gli obblighi contrattuali di diligenza e fedeltà, oltre che a presumere insussistenza della malattia o pregiudicandone la guarigione.
