Deepfake is a modern phenomenon that especially in recent years has grown exponentially with the advancement of technology, this technology poses significant challenges and issues particularly in the criminal law aspect. The term "Deepfake" refers to multimedia content such as photos, videos, and voice recordings that can be altered or even created with the help of artificial intelligence; the improper or even illegal use of this content can lead to real risks, primarily impacting privacy. The thesis, after providing an overview of the Deepfake phenomenon, focusing on its characteristics and critical aspects, aims to offer a reconstruction of the regulatory framework at both the European and national levels. An analysis will be conducted on the main types of criminal phenomena that can arise through the illegal use of such technologies, concluding with reflections on possible future developments in terms of protection.
Il deepfake è un fenomeno moderno che soprattutto negli ultimi anni si è amplificato in maniera esponenziale con l’evolversi della tecnologia, la quale pone sicuramente non poche sfide e problematiche rilevanti sotto l’aspetto penalistico. Con il termine “Deepfake” si intendono quei contenuti multimediali come foto, video, audio vocali, che possono essere alterati o persino creati attraverso l’ausilio dell’intelligenza artificiale; l’utilizzo di questi contenuti in maniera errata o addirittura illecita possono dar luogo a rischi effettivi, incidenti in primo luogo sulla privacy. La tesi, dopo aver fornito una panoramica sul fenomeno “Deepfake”, soffermandosi sulle caratteristiche e criticità, mira a fornire una ricostruzione del quadro normativo a livello sovranazionale ed interno. In particolare, verrà affrontata un’analisi delle principali tipologie di fenomeni criminosi che possono integrarsi attraverso un utilizzo illecito di tali tecnologie, concludendo con delle riflessioni sui possibili sviluppi futuri, in termini di tutela.
