With the advent of the French Revolution, the monopolistic and protectionist system of the modern age was overtaken and new principles based on individualism and freedom of enterprise were established. This change of mentality also has important repercussions on trademark discipline. Following the French model, in 1868 the Italian legislature enacted Law No. 4577 concerning trademarks and distinctive factory signs. The law remained in force for a long time although, starting in the early 1900s, the need for reform began to be felt. The reform process began in October 1906 when the first royal decree was issued to study and propose reforms to be introduced in the existing legislation. The work continued amidst ups and downs until the issuance of Royal Decree No. 1602 of 1934 on the subject of Industrial Privatives and Trademarks. With regard to trademarks, the process ended a few years later with the approval of Royal Decree No. 929 of 1942 entitled Text of legislative provisions on patents for trademarks
Con l’avvento della Rivoluzione francese si supera il sistema monopolistico e protezionista dell’età moderna e si affermano nuovi principi basati sull’individualismo e sulla libertà d’impresa. Questo cambio di mentalità ha importanti ripercussioni anche sulla disciplina dei marchi. Seguendo il modello francese, nel 1868 il legislatore italiano promulga la legge num. 4577 concernente i marchi e i segni distintivi di fabbrica. La legge rimane in vigore a lungo anche se, a partire dai primi del ‘900, si inizia ad avvertire l’esigenza di una riforma. L’iter di riforma inizia nel mese di ottobre 1906 quando viene emanato il primo regio decreto per studiare e proporre le riforme da introdurre nella legislazione vigente. I lavori proseguono tra alterne vicende sino all’emanazione del regio decreto n. 1602 del 1934 in tema di Privative industriali e marchi di fabbrica e di commercio. Per quanto concerne i marchi, l’iter si conclude pochi anni più tardi, con l’approvazione del regio decreto n. 929 del 1942 intitolato Testo delle disposizioni legislative in materia di brevetti per marchi d’impresa.
