This thesis explores the challenges surrounding the protection of three-dimensional trademarks, examining how case law has addressed and interpreted the issues related to their registration. It focuses particularly on the conflicts between recognizing exclusive ownership of a shape and allowing access to that shape as a shared resource. These conflicts raise important questions about balancing innovation protection with fair competition. Additionally, the thesis explores the impact of emerging technologies, such as 3D printing and blockchain, which are redefining the traditional boundaries of intellectual property and raising new concerns about trademark protection and authenticity. The analysis highlights how these technological developments are altering the legal landscape, creating new opportunities but also new risks for businesses and consumers.
Il presente elaborato analizza le difficoltà legate alla protezione dei marchi tridimensionali, esaminando come la giurisprudenza abbia affrontato e interpretato le problematiche connesse alla loro registrazione, con particolare attenzione ai conflitti tra il riconoscimento della proprietà esclusiva sulla forma e l'accessibilità di tale forma come risorsa comune. Tali conflitti sollevano interrogativi sull'equilibrio tra la tutela dell'innovazione e il rispetto della concorrenza. Inoltre, si esplora l'impatto delle tecnologie emergenti, come la stampa 3D e la blockchain, che stanno ridefinendo i limiti tradizionali della proprietà intellettuale e sollevando nuovi interrogativi sulla tutela e l'autenticità dei marchi. L'analisi evidenzia come questi sviluppi tecnologici stiano modificando il panorama legale, creando nuove opportunità ma anche nuovi rischi per le imprese e i consumatori.
