This thesis examines the evolution of the Prüm Treaty and its impact on the Italian Forensic Database, focusing on the regulatory and technological advancements that have radically changed criminal investigations. The thesis is divided into four chapters: the first one analyzes the development of the Prüm system, which recently (in 2024) evolved into the “Prüm II” system; the second one compares the regulatory frameworks of several European countries using a comparative perspective; the third one focuses on the Italian regulation of the DNA database; finally, the fourth one examines our legislation on compulsory sampling as well as some of the more controversial investigative techniques. The reflection on these aspects aims to provide an overview of the role of DNA in criminal investigations, taking into account the most recent developments.
La presente tesi analizza l'evoluzione del Trattato di Prüm e il suo impatto sulla Banca dati forense italiana, concentrandosi sui progressi normativi e tecnologici che hanno rivoluzionato le investigazioni penali. La trattazione si articola in quattro capitoli: nel primo, viene esaminato lo sviluppo del sistema Prüm, evolutosi nel 2024 nel sistema "Prüm II"; nel secondo, in chiave comparatistica vengono confrontate le discipline normative di alcuni Paesi europei; nel terzo, viene approfondita la regolamentazione italiana della banca dati del DNA; nel quarto, viene esaminata la legislazione in tema di prelievo coattivo nonché alcune tecniche investigative maggiormente controverse. La riflessione su tali aspetti ha l'obiettivo di offrire una visione complessiva e circa il ruolo del DNA nelle indagini penali, tenendo conto anche dei più recenti sviluppi in materia.
