The analysis aims to examine the relevance of a new decision making procedure, adopted by the italian Constitutional Court, in the entirety of the relationship between the Constitutional Court and the legislator. Starting from a historical introduction to the topic, to display the background of the research is purpose of this part to immediately bring to light the dual nature of the constitutional justice, meeting point between politics and jurisdiction, beeing able afterword to understand how the relationship between the Court and the legislator is described in the law, and how it has developed in the constitutional jurisprudence through various decision making techniques. Progressively, it’ll be analyzed the transition that has been accomplished from the warning expressions to the decision making technique that will be here defined as “guaranteed double decision”, even known as predicted unconstitutionality, examinating it’s most relevant aspects. Eventually, the thesis would like to come to light how, the many sparkles and connections summarised in this new decision making procedure, arise apical issues both for the legal system, and for the law itself.
L’analisi mira ad indagare il significato di una nuova tecnica decisoria, adottata dalla Corte costituzionale italiana, nel complesso dei rapporti tra la Corte costituzionale e il legislatore. Prendendo le mosse da un’introduzione storica alla materia, per presentare lo sfondo della ricerca si vorrebbe subito mettere in evidenza il carattere duplice della giustizia costituzionale, crocevia tra politica e giurisdizione, per poi inquadrare come il rapporto tra la Corte e il legislatore è definito a livello normativo, e come si è sviluppato in ambito giurisprudenziale attraverso varie tecniche decisorie. Successivamente, ci si occuperà del passaggio che si è compiuto dalle espressioni monitorie alla tecnica che qui viene definita “doppia pronuncia assicurata”, altrimenti nota come incostituzionalità prospettata, delineandone i caratteri salienti. Infine, si vorrebbe far emergere come, dai molti spunti e riferimenti condensati in questa nuova tecnica, prendano respiro questioni apicali, per l’ordinamento giuridico, e per il diritto stesso.
