Carl Schmitt was one of the greatest jurists and political philosophers of the 20th century, and his thought has left an indelible shadow in the history of constitutionalism and law. Although he is currently the most mentioned jurist by German judges, he still remains an uncomfortable figure to exhume, due to the controversial events of his life, with his involvement in the affairs of the Nazi party, and because of his eclectic personality. However, the most recent historical events, from the global pandemic caused by Covid 19 to the Russian-Ukrainian conflict, lead us to confront the thought of the German jurist, in order to determine its effectiveness and compatibility with the global age. This work aims to present itself as a monograph of his work, a sort of "guide to the use" of Carl Schmitt's thought in the global era, in which the asperities and weaknesses of the new international order established from the ashes of world war two are starting to emerge and increasingly undermine the stability of the system itself. In this short paper we will therefore try to understand, relying both directly on the works of Schmitt himself and on those of great critics and scholars of his thought such as Carlo Galli and Gianfranco Miglio, whether Carl Schmitt's thought can still offer, 39 years after his death, ideas and keys to understanding capable of, if not explaining exhaustively, at least shedding some light on the current political (and geopolitical) upheavals of which the law is one of the main agents.
Carl Schmitt è stato uno dei più grandi giuristi e filosofi politici e del diritto del XX secolo, e il suo pensiero ha lasciato un'ombra indelebile nella storia del costituzionalismo e del diritto. Nonostante sia ad oggi il giurista più menzionato dai giudici tedeschi, rimane ancora una figura scomoda da riesumare, a causa delle controverse vicende della sua vita, con il coinvolgimento negli affari del partito nazista, e a causa della sua eclettica personalità. Tuttavia le vicende storiche più recenti, dalla pandemia globale causata dal covid 19 fino al conflitto russo-ucraino, ci inducono a confrontarci con il pensiero del giurista tedesco, al fine di stabilirne l'efficacia e la compatibilità con l'età globale. Questo lavoro ha lo scopo di presentarsi alla stregua di una monografia del suo lavoro, una sorta di "guida all'uso" del pensiero di Carl Schmitt nell'epoca globale, nella quale le asperità e le debolezze insite nel nuovo ordine internazionale instauratosi dalle ceneri della seconda guerra mondiale stanno iniziando ad emergere e ad incrinare sempre più la stabilità del sistema stesso. In questo breve scritto quindi si cercherà di capire, affidandosi sia direttamente alle opere dello stesso Schmitt sia a quelle di grandi critici e studiosi del suo pensiero quali Carlo Galli e Gianfranco Miglio, se il pensiero di Carl Schmitt possa ancora offrire, a 39 anni dalla sua morte, degli spunti e delle chiavi di lettura in grado di se non spiegare esaustivamente, quantomeno gettare delle luci sugli sconvolgimenti politici (e geopolitici) attuali dei quali il diritto è uno dei principali agenti.
