The paper aims to analyze the institution of citizenship and dual citizenship in the Italian republican system, starting with an overview of the evolution of its discipline, highlighting its underlying principles, and, in particular, the transition from the exclusivity of citizenship to the possibility of having more than one. The very important role of the Constitution, as its contribution has been fundamental to the evolution of the subject, will be emphasized. This will be followed by a comparative analysis with other states, in order to highlight the similarities and differences between different legal systems, with a special focus on the role of the European Union and its citizenship, which affects the relations between individuals and between nations. The process of obtaining (dual) Italian citizenship iure sanguinis, a phenomenon that has seen significant growth in the past years, will then be analyzed. We will highlight its critical issues, problems, and proposal of reform, leading, finally, to a reflection on the current value of citizenship.
L’elaborato si propone di analizzare l’istituto della cittadinanza e della doppia cittadinanza nell’ordinamento repubblicano italiano, partendo da uno sguardo sull’evoluzione della sua disciplina, evidenziandone i principi sottostanti e, in particolare, il passaggio dall’esclusività della cittadinanza alla possibilità di averne più di una. Verrà messo in luce il ruolo importantissimo della Costituzione, il cui contributo è stato fondamentale per l’evoluzione della materia. Seguirà un’analisi comparata con altri Stati, in modo da evidenziare le similitudini e differenze tra vari ordinamenti, con uno sguardo particolare al ruolo dell’Unione Europea e della sua cittadinanza, che inevitabilmente influisce sui rapporti tra gli individui e tra le nazioni. Verrà successivamente analizzato il procedimento di ottenimento della (doppia) cittadinanza italiana iure sanguinis, fenomeno che ha registrato una crescita significativa negli ultimi anni. Ne evidenzieremo le criticità, le problematiche e le proposte di riforma, per portare, infine, ad una riflessione sull’odierno valore della cittadinanza.
