This thesis investigates the elusive boundary between eventual intent and conscious negligence, first from a conceptual perspective, then through the testing ground of case law. The discussion is divided into three chapters: in the first one, the subjective element of intent is examined, together with its structure and forms; in the second one, which constitutes the “core” of the work, the vexata quaestio concerning the distinguishing criteria between the two closely related categories is explored, with particular attention to the case law set within contexts characterized by a basic legality; in the third one, the ThyssenKrupp case is analyzed, beginning with a general overview of the Turin plant, followed by a detailed examination of the violations of safety regulations, and concluding with an analysis of the criminal trial. The reflection on these aspects aims to demonstrate how the search for the “perfect formula”, a purely conceptual tool capable of drawing a clear boundary between the two forms of guilt, has always been an utopia.
La presente tesi indaga l’evanescente confine tra dolo eventuale e colpa cosciente, prima sotto il profilo concettuale, poi attraverso il banco di prova della casistica. La trattazione si articola in tre capitoli: nel primo, viene esaminato l’elemento soggettivo del dolo, la sua struttura e le sue forme; nel secondo, che costituisce il “cuore” dell’elaborato, viene approfondita la vexata quaestio relativa ai criteri distintivi tra le due limitrofe categorie, con particolare attenzione alla casistica giurisprudenziale inserita in contesti connotati da una liceità di base; nel terzo, viene esaminato il caso ThyssenKrupp, iniziando con un inquadramento generale dello stabilimento di Torino, per poi approfondire le violazioni della normativa sulla sicurezza, concludendo infine con l'analisi dell'iter processuale. La riflessione su tali aspetti ha l'obiettivo di dimostrare come la ricerca della “formula perfetta”, di uno strumento meramente concettuale che fosse in grado di tracciare un confine netto tra le due forme di colpevolezza, abbia sempre rappresentato un’utopia.
