Surrogacy represents a complex practice involving the gestation of a child on behalf of a third party. The evolution of the family, and procreative, model has resulted in new challenges for legal systems, which have to balance the rights of all those involved. In Europe, the regulation of surrogacy is heterogeneous, and this regulatory unevenness can generate unequal treatment among EU citizens, especially in relation to the transcription of birth certificates of children born by surrogacy abroad. This paper analyzes surrogacy as a borderline case of anti-discrimination policies and fundamental rights protection in the European Union. Through a normative and jurisprudential analysis, the main orientations of member states and European courts are examined, with a focus on the role of the European Court of Human Rights and the Court of Justice of the European Union in bridging the discrepancies between different legal systems.
La maternità surrogata rappresenta una pratica complessa che implica la gestazione di un figlio per conto di terzi. L’evoluzione del modello familiare, e procreativo, ha determinato nuove sfide per i sistemi giuridici, che si trovano a dover bilanciare i diritti di tutti i soggetti coinvolti. In Europa, la regolamentazione della surrogazione è eterogenea e tale disomogeneità normativa può generare disparità di trattamento tra i cittadini dell’Unione, soprattutto in relazione alla trascrizione dei certificati di nascita dei bambini nati da surrogazione all’estero. Il presente lavoro analizza la maternità surrogata come caso limite delle politiche antidiscriminatorie e della tutela dei diritti fondamentali nell’Unione Europea. Attraverso un’analisi normativa e giurisprudenziale, vengono esaminati i principali orientamenti degli Stati membri e delle corti europee, con particolare attenzione al ruolo della Corte Europea dei Diritti dell’Uomo (CEDU) e della Corte di Giustizia dell’Unione Europea (CGUE) nel colmare le discrepanze tra i diversi ordinamenti.
