The present work aims to outline a general framework regarding the legal and social condition of those who belong to a state, citizenship. Particular prominence will be given to the analysis of the term itself and its relationship with its opposite term, statelessness. The basis for the choice of the topic to be discussed was the personal interest in this phenomenon, fueled by the fact that statelessness is a phenomenon that is little known and above all little treated, despite the large numbers that concern it. Being a citizen of the Italian state is a status that is assigned to everyone at birth and to which, for this reason, the right importance is not assigned. It follows that having always been an Italian citizen leads the individual to not take into account the civil, political and social rights that this status brings with it. Therefore, the report develops in two chapters. In the first chapter, citizenship is considered in its necessary definition, with a particular focus on the words of Giovanni Moro taken from his book ‘Cittadinanza’ of 2020. In a second moment, we will list and define the rights and duties of Italian citizens and the consequences that such possession entails. In the second chapter, the condition of statelessness is analyzed, defining its consistency at a legal level and continuing with the analysis of the disparities that emerge from the relationship with the opposite phenomenon of citizenship. In the third chapter, a practical case is analyzed, namely the phenomenon of statelessness in Kosovo.
Il presente lavoro si pone l’obiettivo di delineare un quadro generale in merito alla condizione giuridica e sociale di chi appartiene a uno stato, la cittadinanza. Particolare prominenza sarà data all’analisi del termine stesso e al suo rapporto con il suo termine contrario, l’apolidia. Alla base della scelta dell’argomento da trattare fondamentale è stato l’interesse personale verso tale fenomeno, alimentato dal fatto che l’apolidia è fenomeno poco conosciuto e soprattutto poco trattato, nonostante i grandi numeri che lo riguardano. Essere cittadini dello stato italiano è uno status che viene assegnato ad ognuno alla nascita e a cui, per tale motivo, non viene assegnata la giusta importanza. Ne consegue che essere da sempre un cittadino italiano, porta l’individuo a non tenere conto dei diritti civili, politici e sociali che questo status porta con sé. Pertanto, la relazione si sviluppa in due capitoli. Nel primo capitolo, la cittadinanza viene considerata nella sua doverosa definizione, con un particolare focus sulle parole di Giovanni Moro tratte dal suo libro ‘Cittadinanza’ del 2020. In un secondo momento, si passerà ad elencare e definire quelli che sono i diritti e i doveri dei cittadini italiani e le conseguenze che tale possesso comporta. Nel secondo capitolo, si analizza la condizione di apolidia, definendo a livello giuridico la sua consistenza e proseguendo con l’analisi delle disparità che emergono dal rapporto con il fenomeno contrario della cittadinanza. Nel terzo capitolo, viene analizzato un caso pratico, ovvero il fenomeno dell’apolidia in Kosovo.
