The ubiquitous spread of NFTs in the artistic landscape raises serious questions regarding their reliability as a copyright protection instruments. Legal scholars have mainly focused on the theoretical aspects of NFTs, sometimes neglecting a necessary analysis of their technical nature. The question facing copyright law scholars is whether traditional legal categories are suitable to regulate this innovative phenomenon. This thesis is structured as a systematic study, where technological functioning, legal theory, and case law concerning NFTs are interpolated to define the various aspects of this multifaceted instrument. The study has shown that traditional legal categories are, in the definitional phase, suitable to frame this instrument from different perspectives, while being sufficiently flexible to effectively regulate the use of NFTs as a representative instrument of copyright and capable of promoting its protection. This means that artists have at their disposal a new and powerful instrument to protect their rights, which promotes disintermediation and makes the art market more accessible to the public.
La diffusione ubiqua dei NFT nel panorama artistico pone seri interrogativi in ordine alla loro solidità come strumento di tutela del diritto d’autore. La dottrina si è focalizzata principalmente sugli aspetti teorici dei NFT, a volte tralasciando una pur necessaria analisi delle loro caratteristiche tecniche. La questione che si pone allo studioso del diritto autoriale è se le categorie giuridiche tradizionali siano idonee a regolare questo innovativo fenomeno. La seguente tesi si struttura come uno studio sistematico, nel quale il funzionamento tecnologico, la teoria giuridica e la giurisprudenza in tema di NFT sono interpolati per definire i diversi aspetti di questo poliedrico strumento. Lo studio ha evidenziato come le categorie giuridiche tradizionali siano, in fase definitoria, idonee a inquadrare questo strumento in diverse prospettive, mentre sono sufficientemente elastiche da disciplinare efficacemente l’uso dei NFT come strumento rappresentativo dei diritti autoriali e capaci di favorirne la tutela. Questo significa che gli artisti hanno a disposizione un nuovo e potente strumento per tutelare i loro diritti, il quale favorisce la disintermediazione e rende più accessibile al pubblico il mercato dell’arte.
