The thesis explores the paradigm of Conflict Transformation, an innovative and multidimensional approach to the management and transformation of conflicts, analyzed through a philosophical and legal perspective. The aim is to provide contemporary jurists with theoretical and practical tools to understand and address conflict dynamics, not merely from the perspective of conflict resolution but as opportunities for growth and social change. Through a critical analysis of the main philosophical and legal theories underpinning the conceptual foundations of the paradigm, the argument highlights how Conflict Transformation surpasses the limitations of traditional conflict resolution techniques by promoting a systemic and relational vision. The thesis also focuses on the role of law and its institutions in fostering processes of "conversion of conflict into dispute" and sustainable transformation, with particular attention to mediation, restorative justice, and peacebuilding, including through intercultural dialogue. The applied section examines concrete cases and innovative legal practices, demonstrating how the paradigm can be integrated into the jurist's practice at both the training and methodological levels in dispute management. In a global context characterized by high complexity and interdependence, the paradigm of Conflict Transformation emerges as an essential interpretative framework for rethinking the role of law in contemporary society in favor of a transformative conception of justice.
La tesi esplora il paradigma della Conflict Transformation ovvero un approccio innovativo e multidimensionale alla gestione e alla trasformazione dei conflitti, analizzato attraverso una prospettiva filosofico giuridica. L'obiettivo è fornire al giurista contemporaneo strumenti teorici e pratici per comprendere e affrontare le dinamiche conflittuali, non solo rispetto ad una prospettiva di risoluzione del conflitto, ma come opportunità di crescita e cambiamneto sociale. Attraverso un'analisi critica delle principali teorie filosofiche e giuridiche che sostengono le premesse concettuali del paradigma, l'argomentazione evidenzia come la Conflict Transformation superi i limiti delle tradizionali tecniche di risoluzione dei conflitti, promuovendo una visione sistemica e relazionale. La tesi si concentra inoltre sul ruolo del diritto e dei suoi istituti nel favorire processi di "conversione del conflitto in controversia" e trasformazione sostenibile, con particolare attenzione alla mediazione, alla giustizia riparativa e alla costruzione della pace anche mediante il dialogo interculturale. La parte applicativa esamina casi concreti e prassi giuridiche innovative, dimostrando come il paradigma possa essere integrato nella prassi del giurista a livello di formazione e metodologico nella gestione delle controversie. In un contesto globale caratterizzato da elevata complessità e interdipendenza, il paradigma della Conflict Transformation si propone come una chiave interpretativa essenziale per ripensare il ruolo del diritto nella società contemporanea a favore di una certa idea di giustizia trasformativa.
