In recent decades food regulation is taking a role of fundamental national, EU and international interest . Thanks to scientific and technological developments and transnational trade in goods and foods, Member States have developed an interest in introducing foods into their markets that have not established use in earlier times, bringing with them the need for new forms of protection and regulations. Novel foods found their first definition and form of regulation in the last years of the last century, until today we are witnessing a much broader and harmonized regulatory and jurisprudential framework. In this thesis, will be analysed the role and autonomy of the Member states as they maintain strong sovereignty interest in this field, in which are intertwined issues such as food safety (understood as both food security and food safety), fundamental principles such as the precautionary principle, protection of competition, the authorization procedure for the introduction of a novel food and risk analysis for which Member states want to keep a voice.
La legislazione alimentare negli ultimi decenni sta assumendo sempre più un ruolo di fondamentale interesse non solo nazionale, bensì comunitario e internazionale. Grazie agli sviluppi scientifici e tecnologici e agli scambi transnazionali di beni e alimenti gli stati membri hanno maturato l’interesse per introdurre nei loro mercati alimenti che non hanno un uso consolidato in tempi antecedenti, portando con sé l’esigenza di nuove forme di tutela e regolamentazioni. I Novel foods trovano una prima definizione e forma di disciplina negli ultimi anni del secolo scorso, fino ad arrivare ad assistere, oggi, ad un quadro normativo e giurisprudenziale ben più ampio e armonizzato. In questa tesi verrà affrontato il ruolo e lo spazio di autonomia che spetta agli Stati membri in quanto rimangono forti gli interessi nazionali di mantenere una sovranità in questa materia, nella quale si intrecciano temi come la sicurezza alimentare (intesa sia come food security sia come food safety), principi fondamentali come il principio di precauzione, tutela della concorrenza, la procedura di autorizzazione per l’introduzione di un nuovo alimento e l’analisi del rischio per i quali gli Stati membri vogliono mantenere voce in capitolo.
