The thesis addresses the theme of trial review, which represents one of the most delicate and controversial institutions of criminal procedural law as it is at the center of two important themes: the immutability of the final sentence and the protection of the fundamental rights of the convicted person. In particular, the thesis aims to analyze in depth the prerequisites and limits provided for by the Italian legal system in order to access this extraordinary remedy, as well as identify the "fixed points" consolidated by jurisprudence and doctrine, focusing on the conditions that legitimize the request for review. At the same time, it aims to explore the "unresolved issues", i.e. the critical issues and questions that are still open, such as the notion of supervening evidence, the discrepancy between jurisprudential rulings in some specific cases, particular attention is paid to the role of new technologies and forensic sciences in the review process, and the ethical and legal implications arising from the use of such tools. The thesis concludes with the analysis of a practical case of auditing which has had considerable media relevance.
La tesi affronta il tema della revisione del processo, la quale rappresenta uno degli istituti più delicati e controversi del diritto processuale penale in quanto si pone al centro di due rilevanti temi: l’immutabilità della sentenza passata in giudicato e la tutela dei diritti fondamentali della persona condannata. In particolare, l’elaborato si propone di analizzare in modo approfondito i presupposti e limiti previsti dall’ordinamento italiano al fine di accedere a tale rimedio straordinario, nonché identificare i “punti fermi” consolidati dalla giurisprudenza e dalla dottrina soffermandosi sulle condizioni che legittimano la richiesta di revisione. Al contempo, si propone di esplorare i “nodi irrisolti”, ovvero le criticità e le questioni tuttora aperte, come la nozione di prove sopravvenute, la discordanza delle pronunce giurisprudenziali in alcuni casi specifici, particolare attenzione è riservata al ruolo delle nuove tecnologie e delle scienze forensi nel processo di revisione, e alle implicazioni etiche e giuridiche derivanti dall’uso di tali strumenti. L’elaborato si conclude con l’analisi di un caso pratico di revisione che ha avuto notevole rilevanza mediatica.
