The thesis examines the intersection between Digital Forensics and Open Source Intelligence (OSINT) in criminal investigations, with a focus on the acquisition of digital evidence online. Digital evidence is increasingly crucial in criminal proceedings, extending the role of Digital Forensics beyond cybercrimes. Digital Forensics deals with the acquisition of digital data for procedural purposes, ensuring integrity and authenticity. OSINT collects and analyzes information from open sources, acting as a complementary activity to traditional investigations. Its sources, critical issues, and the operational cycle in its various phases are explored, along with an analysis of the main legal problems related to the activity, such as the classification of sources on social networks and the regulation of personal data in relation to the GDPR (Reg. EU 679/2016) and the PDPD (Dir. EU 680/2016). The integration between Digital Forensics and OSINT is fundamental to address the challenges of digital investigations, with OSINT serving as a complementary activity to investigations. Some methods of forensic acquisition of evidence on the web are illustrated, explaining the different methodologies and tools to preserve the probative integrity of volatile and manipulable information. Finally, the impact of Artificial Intelligence is also analyzed, highlighting its potential to improve the efficiency and accuracy of investigations, but also the critical issues related to the admissibility of evidence and the transparency of algorithms
La tesi esamina l'intersezione tra Digital Forensics e Open Source Intelligence (OSINT) nelle indagini penali, con un focus sull'acquisizione di prove digitali online. La prova digitale è sempre più cruciale nei processi penali, estendendo il ruolo della Digital Forensics oltre i crimini informatici. La Digital Forensics si occupa dell’acquisizione dei dati digitali ai fini processuali, garantendo integrità e autenticità. L'OSINT raccoglie e analizza informazioni da fonti aperte, agendo come attività complementare alle indagini tradizionali. Vengono esplorate le sue fonti, le sue criticità e il ciclo operativo nelle sue varie fasi, con un’analisi sui i principali problemi giuridici legati all'attività, come la classificazione delle fonti sui social network e la regolamentazione dei dati personali in relazione al GDPR (Reg. UE 679/2016) e alla PDPD (Dir. UE 680/2016). L'integrazione tra Digital Forensics e OSINT è fondamentale per affrontare le sfide delle indagini digitali, con l'OSINT che funge da attività complementare alle indagini. Vengono illustrati alcuni metodi di acquisizione forense di prove sul web, spiegando le diverse metodologie e strumenti per preservare l'integrità probatoria di informazioni volatili e manipolabili. Infine, viene analizzato anche l’impatto dell’Intelligenza Artificiale, evidenziandone le potenzialità per migliorare l'efficienza e l'accuratezza delle indagini, ma anche le criticità legate all'ammissibilità delle prove e alla trasparenza degli algoritmi.
