This thesis focuses on the relationship between two core principles of the German legal system, the principle of proportionality (Verhältnismäßigkeitsgrundsatz) and the separation of powers (Gewaltenteilung). It is divided into three chapters. Chapter I focuses on proportionality and its three-stage test conducted by the German Federal Constitutional Court; Chapter II introduces the concept of “mild” separation of powers and describes how it is organised in the Federal Republic of Germany; finally, Chapter III critically analyses the interaction between these two principles. The object pursued by the present research is twofold. Firstly, it aims to provide a sufficiently detailed picture of the fundamental features of the principle of proportionality and the separation of powers in one of Europe’s most influential constitutional systems, the German one. It also emphasises the relationship between these two principles. In doing so, it highlights the existence of a common basis between proportionality and the separation of powers, namely the principle of the rule of law – the “Rechtsstaatsprinzip”. Finally, it shows that they play a fundamental role in maintaining the rule of law, as they function as reciprocal limits and justifications, ensuring the preservation of the Rechtsstaat itself. More specifically, they interact in a way that limits state powers with the ultimate goal of protecting fundamental individual rights.
La presente tesi si concentra sulla relazione tra due principi fondamentali dell’ordinamento giuridico tedesco, il principio di proporzionalità (Verhältnismäßigkeitsgrundsatz) e la separazione dei poteri (Gewaltenteilung). Il Capitolo I si concentra sulla proporzionalità e sul cosiddetto “test di proporzionalità”, condotto in tre fasi dalla Corte costituzionale Federale; il Capitolo II introduce il concetto di separazione “mite” dei poteri e descrive come essa sia organizzata nella Repubblica federale di Germania; infine, il Capitolo III analizza criticamente l’interazione tra questi due principi. L’obiettivo perseguito dalla presente ricerca è duplice. In primis, essa mira a fornire un quadro sufficientemente dettagliato delle caratteristiche fondamentali del principio di proporzionalità e della separazione dei poteri in uno dei sistemi costituzionali più influenti d’Europa, quello tedesco. Inoltre, pone l’accento sul rapporto tra questi due principi. Così facendo, evidenzia l’esistenza di una base comune tra la proporzionalità e la separazione dei poteri, vale a dire il principio dello stato di diritto – il “Rechtsstaatsprinzip”. Infine, dimostra che questi due principi svolgono un ruolo fondamentale nel mantenimento del Rechtsstaat. Grazie ad un’azione rispettivamente limitante e di salvaguardia, essi interagiscono in modo da contenere i poteri statali con l’obiettivo ultimo di proteggere i diritti individuali, garantendo così la conservazione dello stato di diritto.
