This thesis aims to analyze the legal institutions of separation and divorce, subject to significant reforms introduced by Legislative Decree number 149 of 2022. The analysis will extend to the new procedural discipline introduced for these institutions, with particular reference to the new unified rite for family disputes. In addition, the critical aspects related to the establishment of the new court for minors, families and individuals will be addressed, highlighting the challenges and opportunities that this innovation brings. Subsequently, the examination of the judgment number 28727 of 2023 of the Court of Cassation will follow, which puts an end to important hermeneutic strands based on the possibility of extending the novelty of the cumulation of applications for separation and divorce under Article 473 bis 49 of the Code of Civil Procedure also in consensual proceedings, in relation to Article 473 bis 51 of the same Code. As the judgment is also the first example of the use of the instrument also introduced by the Cartabia reform, such as the preliminary ruling pursuant to article 363 bis of the Code of Civil Procedure, there will be an analysis of this institute.. A focus will also be devoted to the assisted negotiation and private autonomy of spouses, always contextualized in the context of separation and divorce. Through a critical and systematic approach, the thesis aims to provide an exhaustive picture of new legislation and case law, highlighting the practical and theoretical implications of these institutions in the context of marital relations.
La presente tesi si propone di analizzare gli istituti giuridici della separazione e del divorzio, oggetto di significative riforme introdotte dal decreto legislativo numero 149 del 2022. L'analisi si estenderà alla nuova disciplina processuale introdotta per questi istituti, con particolare riferimento al nuovo rito unificato per le controversie familiaristiche. Inoltre, si tratteranno gli aspetti critici legati all'istituzione del nuovo tribunale per i minorenni, per la famiglia e per le persone, evidenziando le sfide e le opportunità che tale innovazione comporta. Successivamente seguirà l’esame della sentenza numero 28727 del 2023 della Corte di Cassazione, la quale pone fine a importanti filoni ermeneutici basati sulla possibilità di estendere la novità del cumulo di domande di separazione e divorzio ex articolo 473 bis 49 del codice di procedura civile anche nel procedimento consensuale, in relazione all’articolo 473 bis 51 dello stesso codice. Siccome la sentenza è anche il primo esempio dell’utilizzo dello strumento anch’esso introdotto dalla riforma Cartabia, quale il rinvio pregiudiziale ex articolo 363 bis del codice di procedura civile, vi sarà un’analisi anche di questo istituto. Un focus sarà dedicato, altresì, alla negoziazione assistita e all'autonomia privata dei coniugi, sempre contestualizzati nell'ambito della separazione e del divorzio. Attraverso un approccio critico e sistematico, la tesi intende fornire un quadro esaustivo delle novità normative e giurisprudenziali, evidenziando le implicazioni pratiche e teoriche di tali istituti nel contesto delle relazioni coniugali.
