L’abuso del Decreto Legge

The decree-law, governed by Article 77 of the Italian Constitution, represents an instrument of extraordinary legislation reserved for the government to deal with situations of necessity and urgency. However, practice has shown an improper use of this institution, often characterized by the circumvention of the normal legislative process and regulatory overcrowding lacking the requirements of emergency. This misuse undermines the principle of separation of powers and raises questions about the centrality of Parliament in the legislative process. This study analyzes the main application distortions, with a focus on their constitutional repercussions, and proposes some solutions to restore the balance between the powers of the state.

Il decreto-legge, disciplinato dall’art. 77 della Costituzione italiana, rappresenta uno strumento di legislazione straordinaria riservato al Governo per fronteggiare situazioni di necessità e urgenza. Tuttavia, la prassi ha evidenziato un utilizzo improprio di tale istituto, spesso caratterizzato dall’elusione del normale iter legislativo e da un sovraffollamento normativo privo dei requisiti di emergenza. Questo abuso mina il principio di separazione dei poteri e solleva questioni sulla centralità del Parlamento nel processo legislativo. Il presente studio analizza le principali distorsioni applicative, con un focus sulle loro ripercussioni costituzionali, proponendo alcune soluzioni per ristabilire l’equilibrio tra i poteri dello Stato.
