The thesis examines the growing role of non-state actors in international law, with a specific focus on the protection of children’s rights. Through theoretical analysis and concrete case studies, it highlights how non-governmental organizations, businesses, foundations, and civil society contribute to filling the gaps left by states in safeguarding children, especially in contexts of armed conflict, poverty, and inequality. Particular attention is given to the evolution of international law, the UN Convention on the Rights of the Child, and the Third Optional Protocol, a mechanism that strengthens children’s access to justice. The research underscores the importance of cooperation between states and non-state actors to promote a more effective and inclusive protection of children’s rights.
La tesi analizza il ruolo crescente degli attori non statali nel diritto internazionale, con un focus specifico sulla protezione dei diritti dei minori. Attraverso un’analisi teorica e casi studio concreti, viene illustrato come organizzazioni non governative, imprese, fondazioni e società civile contribuiscano a colmare le lacune lasciate dagli Stati nella tutela dei bambini, soprattutto in contesti di conflitto armato, povertà e disuguaglianze. Particolare attenzione è dedicata all’evoluzione normativa internazionale, alla Convenzione ONU sui Diritti del Fanciullo e al Terzo Protocollo Opzionale, strumento che rafforza l’accesso alla giustizia per i minori. La ricerca evidenzia l’importanza della cooperazione tra Stati e attori non statali per promuovere una protezione più efficace e inclusiva dei diritti dell’infanzia.
