La tesi da una breve introduzioni sulla realtà delle comunità indigene dell'America Latina, sui loro diritti, la violazione degli stessi da parte delle imprese che si arricchiscono grazie ai loro territori, successivamente si analizza a livello normativo gli strumenti esistenti come i Guiding Principles, la DDHR, l'Accordo di Escazù per capire com'è integrata la due diligence al loro interno e alcuni casi di studio.
