This thesis examines the right to a name from a legal-historical and existential perspective, reconstructing its legal evolution and highlighting its importance as a fundamental element of personal identity. The first chapter traces the connotations assumed by the name throughout history and examines the main legal sources governing its attribution, modification and protection. Particular attention is paid to the close correlation between the right to a name and the right to personal identity as an expression of individual subjectivity. The second chapter focuses on the discipline of assigning a surname to children, analysing its historical and cultural roots. It also reconstructs the path that, through the evolution of jurisprudence, has led to the overcoming of the rule of automatic transmission of the paternal surname, culminating in the recent Constitutional Court decision no. 131/2022. The final chapter is intended to provide an analysis of ruling no. 131/2022, focusing on the critical issues in its application and future prospects.
La tesi esamina il diritto al nome da una prospettiva storico-giuridica ed esistenziale, ne ricostruisce l’evoluzione normativa e mette in luce la sua importanza come elemento fondamentale dell’identità personale. Nel primo capitolo si ripercorrono le connotazioni assunte dal nome nel corso della storia e si esaminano le principali fonti giuridiche che ne disciplinano l’attribuzione, la modifica e la tutela. Particolare attenzione è riservata alla stretta correlazione tra il diritto al nome e il diritto all’identità personale, quale espressione della soggettività individuale. Il secondo capitolo si concentra sulla disciplina dell’attribuzione del cognome ai figli, analizzandone le radici storiche e culturali. Si ricostruisce, inoltre, il percorso che, attraverso l’evoluzione giurisprudenziale, ha condotto al superamento della regola dell’automatica trasmissione del cognome paterno, culminato nella recente sentenza n. 131/2022 della Corte costituzionale. L’ultimo capitolo è dedicato all’analisi della sentenza n. 131/2022, ponendo attenzione alle criticità applicative e alle prospettive future.
