The thesis offers an in-depth analysis of the institution of adoption from historical, legal, and psychological perspectives. It traces the evolution of adoption from its origins in Roman law to the current legal framework, focusing on the legal grounds for full adoption of minors, including the requirements for adoptive parents (such as marriage, age, and suitability), and the various forms of adoption, including special cases, international adoption, and adult adoption. It then explores the sensitive aspects of the post-adoption phase, such as the adoptee’s right to know their origins, the protection of the biological parents’ privacy, relationships with biological siblings, psychological support, and the possibility of revocation, ultimately questioning the overall effectiveness of the contemporary adoption system.
La tesi analizza in modo approfondito l’istituto dell’adozione sotto il profilo storico, normativo e psicologico. Si ricostruisce l’evoluzione dell’adozione, dalle sue origini nel diritto romano fino alla normativa attuale, soffermandosi sui presupposti giuridici per l’adozione legittimante dei minorenni, inclusi i requisiti degli adottanti (come il matrimonio, l’età, l’idoneità) e le diverse tipologie di adozione, comprese quelle in casi particolari, internazionali e dei maggiorenni. Per poi esplorare i delicati aspetti del post-adozione, come il diritto dell’adottato a conoscere le proprie origini, la tutela della privacy dei genitori biologici, i legami con i fratelli naturali, il supporto psicologico e la possibilità di revoca, interrogandosi infine sull’efficacia complessiva del sistema adottivo contemporaneo.
